In recent years, the short-term vacation rental market has seen explosive growth in Toulouse, attracting an increasing number of visitors to the "Pink City." Owners of primary and secondary residences have seized the opportunity created by this appeal and have entered the Airbnb rental market in Toulouse.

‍

However, this popularity has also created certain issues, particularly regarding its impact on the local real estate market. Consequently, in order to better regulate this activity, the Toulouse Metropolitan Council decided to strengthen the regulations surrounding furnished tourist accommodations starting November 1, 2023.

‍

In this article, we will explain the main measures put in place and what they mean for owners and tenants of these tourist accommodations.

‍

Renting out a primary residence for short-term stays in Toulouse

Primary residences will not be affected by the new regulatory measures implemented starting November 1, 2023. The process for renting out these residences remains unchanged, as do the regulations governing it. It is possible to rent out a primary residence as a vacation rental for only 120 days per year. Beyond that, you must comply with the regulations applicable to secondary residences.

‍

The process of renting out a primary residence for short-term stays consists of:

  • Registering your property online as a furnished tourist accommodation
  • Obtaining a 13-character registration number to be used on booking platforms following the registration.
  • Paying the tourist tax starting from the first bookings

‍

Regarding the tourist tax, it is paid by travelers, but it must be collected by hosts and then remitted to the Toulouse City Hall. Depending on the platforms where the property is listed, the tourist tax is collected and remitted directly by the platform. This is notably the case for booking platforms like Airbnb, Abritel, and Booking.

‍

If the platform does not collect the tax, a dedicated platform for its declaration and payment is provided by the city. The rate is set per person, per night.

‍

Renting out a secondary residence for short-term stays in Toulouse

The process of renting out a secondary residence is more complex than that for primary residences. Since a secondary residence can be rented out as a vacation rental all year round without interruption, it is necessary to change its designated use. To do this, you must apply for a change-of-use authorization, which allows you to declare the premises as an economic activity.

‍

To obtain a change-of-use authorization, you must fill out the form and send it by email to changement.usage@mairie-toulouse.fr or drop it off directly at the urban planning authorization reception desk at Toulouse City Hall, 1 Place des Carmes.

‍

Once the authorization is obtained, you must get a registration number to include on all booking platforms where the property is listed. Finally, starting from the first bookings, the tourist tax must be collected from travelers and remitted to the City Hall via the dedicated platform.

‍

Paying the tourist tax in Toulouse

To pay the tourist tax in Toulouse, a dedicated platform has been set up. Declaration and payment are done online after creating a personal account, according to a set schedule. Taxes collected from:

‍

  • January 1 to March 31 must be declared and paid before April 30.
  • April 1 to June 30 must be declared and paid before July 31.
  • July 1 to September 30 must be declared and paid before October 31.
  • October 1 to December 31 must be declared and paid before January 31.

‍

The cost of the tourist tax in Toulouse is 5% of the nightly rate per person. As of January 1, 2023, a 10% departmental tax is added to this.

‍

New regulations for furnished tourist accommodations in Toulouse

On October 20, 2022, the Toulouse Metropolitan Council announced the implementation of new regulations to further regulate furnished tourist accommodations starting November 1, 2023. This new measure aims to regulate the rise of furnished tourist accommodations in the city and establish a balance between residential housing and vacation rentals.

‍

This new regulation introduces a compensation principle for the short-term rental of a secondary residence, depending on its location. Three zones have been defined: the city center, the suburbs, and the rest of the Toulouse territory. Some ambiguity remains regarding their specific regulatory differences, as it appears the same system applies to all three zones.

‍

The compensation principle, set to take effect in Toulouse, requires hosts to simultaneously list two properties on the market: one for a long-term residential lease and another for short-term rental. Both properties must be of equivalent size and located within the same zone. Finally, one of the two properties must be a commercial space converted into a residential unit (excluding ground floors).

‍

This mandatory compensation measure applies to legal entities as soon as one property is listed for short-term rental, and to individuals starting from 3 properties listed for short-term rental in Toulouse.
