It is time to take stock of the regulations surrounding Airbnb rentals in Marseille. There is a specific process to follow for renting out a primary and/or secondary residence on a short-term basis. However, an increasing number of properties are being offered as vacation rentals, which is harming the Marseille real estate market, notably by driving up purchase prices. To address this phenomenon, the City Council has decided to tighten its regulations for listing properties on Airbnb. Let's look at what has been in place since May 20, 2021.
How do you list a property for Airbnb rental in Marseille?
The first step to listing a property for short-term rental in Marseille is to register it with the city hall. This declaration allows the city to recognize your property as a tourist rental and grant it the status of a furnished tourist accommodation. Without changing your property's status, it is not possible to legally rent it out on a short-term basis. To complete this declaration, simply create an account and fill out the online form.
Once declared as a furnished tourist accommodation, you will receive a registration number that you will be required to provide on booking platforms to publish your listing. This registration number has been mandatory for Airbnb rentals since 2019.
For primary residences, the process ends there; once your vacation rental listing is online, you can accept bookings for up to 120 days. However, for secondary residences, you must complete an additional step if you wish to rent your property on a short-term basis. After declaring your property as a furnished tourist accommodation, you must obtain authorization for a change of use from the city of Marseille. Following the receipt of this change of use authorization, you will obtain your registration number to publish your listing.
What must owners do once the property is rented in Marseille?
Once your property in Marseille is rented and travelers are staying in your primary or secondary residence, you must pay the tourist tax. This tax is remitted to the city of Marseille to enable the metropolitan area to implement new initiatives to develop tourism in the region. You will need to pay this tax directly via the dedicated platform from your personal account.

What does the new regulation for vacation rental owners in Marseille consist of?
Since May 29, 2021, the Marseille City Council has decided to further regulate short-term rentals. The new regulation aims to limit the increase in secondary residences rented on a short-term basis. Until now, owners were allowed to rent up to 5 secondary residences and one primary residence. However, with requests for change of use authorization having steadily increased over the last four years, the city wants to slow down the short-term rental of secondary residences.
From now on, owners will be able to list one secondary residence on Airbnb for a limit of 8 months, without exceeding 90 consecutive days for the same tenant. A primary residence can be rented for a maximum of 120 days per year. If an owner wants to rent a second secondary residence or more, they must comply with the principle of compensation or risk having their change of use authorization, which is necessary for listing their property, denied. The principle of compensation consists of simultaneously putting a residential property and a short-term rental property on the market by the same owner. When applying to rent a secondary residence, the owner must prove to the city hall that they will also be renting out a residential property in the same sector and of the same size as the one listed on Airbnb.
What should you do if you have pending change of use authorizations in Marseille?
Owners who already possess several secondary residences for vacation rental will have to comply with this regulation as soon as their current change of use authorization, which were previously valid for 6 years, expires. Note also that new change of use authorizations issued will henceforth be valid for 4 years and will no longer be automatically renewed.
This new regulation regarding furnished tourist accommodations allows the city of Marseille to further regulate vacation rentals by private individuals in order to rebalance the number of properties available for long-term and short-term rental. This will also help to reduce the pressure on real estate prices, which can reach 12,000 per square meter in certain neighborhoods.
