Short-term rentals in Marseille are subject to specific regulations that must be taken into account, with procedures to follow before listing a property. The city requires certain declarations for all short-term rentals listed on booking platforms like Airbnb and Booking.com. Once the property is listed, other requirements apply, such as paying the tourist tax or declaring your rental income. In this article, we explain everything you need to know about the regulations surrounding short-term rentals in Marseille.
Important update (2025): Short-term rental regulations in Marseille were significantly tightened in 2025. Primary residences can now only be rented for 90 days per year (down from 120), and a change of use for secondary residences now requires compensation starting from the very first property. We detail all these new rules in this article.
Do I need to register my property as a tourist furnished rental with the city hall?
The Marseille city hall requires a tourist furnished rental declaration for both primary and secondary residences. Indeed, as soon as you rent out your primary or secondary residence for short stays (by the night, week, or month) for periods not exceeding 90 consecutive days, you are required to declare it to the Marseille city hall. To do this, simply fill out the CERFA No. 14004*03 form, which is the official declaration for tourist furnished rentals.
When filling out your declaration, you will be asked for several pieces of information:
- the address of your primary residence,
- the address of the property to be rented,
- its layout.
Once your property is registered as a tourist furnished rental, the listing procedures vary depending on the nature of your residence.
Regulations for primary residences in Marseille
First and foremost, you should know that you can only rent out your primary residence as a short-term rental for a maximum of 90 days per year as of February 2025 (down from 120 days previously). Exceeding this limit can result in a civil fine of €15,000. Once your tourist rental is registered, you must obtain your registration number, which you will use to post your listing on platforms like Airbnb, Booking, Abritel, etc. You obtain this registration number as soon as your account has been created on the Marseille tourist tax management platform.
Simply:
- log in to your host portal,
- choose the "My rental properties" section,
- select the "Create a number" tab.
Regulations for secondary residences in Marseille
For secondary residences, after declaring your property as a tourist furnished rental, you must also obtain authorization for a change of use from the Urban Planning Authorization Department by filling out the change of use form issued by the city of Marseille.
This request for change of use authorization should be sent to: Direction de l'Urbanisme / Service des Autorisations d'Urbanisme - 40 rue Fauchier - 13233 Marseille Cedex 20.
Warning: As of April 29, 2025, regulations in Marseille have become significantly stricter. Temporary change of use authorizations for tourist furnished rentals are no longer issued. From now on, any request for a change of use for a secondary residence is subject to mandatory compensation starting from the 1st property: you must convert commercial premises into residential housing or offer an equivalent property on the long-term rental market. Authorizations already obtained before this date remain valid until they expire.
After obtaining this authorization, you must get your registration number from your personal account by following the same procedure as for primary residences.
This specific requirement for a change of use request for secondary residences stems from the fact that your secondary residence's status changes from residential use to commercial use as soon as you generate rental income. The change of use authorization in Marseille is valid for 4 years (reduced from 6 years previously). Once this period expires, if you wish to continue short-term renting your secondary residence, you will need to reapply. Since April 2025, for this request to be approved, you must:
- accompany the change of use with compensation (converting commercial premises into housing or offering an equivalent property for long-term rental),
- ensure the short-term rental period does not exceed 8 months,
- ensure tenants do not rent your property for more than 90 consecutive days.
How do I pay the tourist tax in Marseille?
Every rental must be accompanied by the payment of the tourist tax. The travelers you host in your home for short stays generate expenses for the city of Marseille. This is why, when a tenant makes a booking (via Airbnb, Booking.com, Abritel, etc.) for your vacation rental, a certain amount per night must be paid by the tenants to the city of Marseille. How you declare your tourist tax depends on the platform where your listing is published:
- Airbnb, Abritel, and Booking.com collect the tourist tax directly at the time the stay is booked by travelers, and the platforms are responsible for remitting it to the city of Marseille.
- Other booking platforms like le Club Welkeys have not yet automated collection, so you must visit the dedicated interface to file your declaration and make the payment. Don't worry, the process is simple: register on the platform and follow the instructions.
For your information, the tourist tax must be paid monthly and can be done via online payment, bank transfer, or check. For non-classified tourist accommodations, it amounts to 5% of the pre-tax cost per night per person, capped at €4.00. Added to this amount are a 10% departmental additional tax and a 34% regional additional tax (introduced in 2023 to fund the Ligne Nouvelle Provence Côte d'Azur). Platforms like Airbnb, Booking.com, and Abritel automatically collect and remit these taxes.
The final rule when renting on a seasonal basis is that you must report your rental income in your tax return once a year.
