Since January 2022, new regulations regarding furnished tourist accommodations have been in effect in Bandol. This new legislation was designed and implemented to monitor seasonal rentals and limit their impact on the local real estate market. With the rise of the short-term rental market, an increasing number of Airbnb listings are appearing in the town of Bandol, which in turn reduces the availability of residential housing and increases pressure on real estate prices.

‍

To address this and regulate this type of rental, the Bandol Municipal Council, following deliberation, decided to introduce a new step in the process of registering a property as a furnished tourist accommodation. But what does this new regulation for short-term rentals in Bandol entail?

‍

Registration as a furnished tourist accommodation and registration number

The obligation to register your property as a furnished tourist accommodation remains unchanged for owners of primary and secondary residences. The registration must be completed online via the form available on Décla Loc. Regardless of the type of residence listed on Airbnb, you must register your property using this same form. During the registration process, you will be able to indicate whether it is a primary or secondary residence.

‍

Once your registration is complete, you will receive a 13-digit registration number. You will need this to list your property and create ads on booking platforms. You can no longer create a listing without entering your registration number. This has become an essential step for the listing to be created and published. This applies to both primary and secondary residences.

‍

Note: Primary residences can only be rented for 120 days per year. A secondary residence can be rented without limitation throughout the year.

‍

Application for change of use authorization

In addition to the registration number, the new regulation adds a step to the process of renting out secondary residences. If you wish to rent out your secondary residence in Bandol, after registering it, you must submit an application for a change of use authorization.

‍

This application is made following the registration as a furnished tourist accommodation form completed on Décla Loc. You will need to continue on the site by selecting "Change of use" to proceed with filling out the form and completing the procedures. You will receive your registration number after your application is validated. Both the change of use authorization and the registration number are valid for 5 years but can be terminated at any time.

‍

Collection of the tourist tax in Bandol

The tourist tax must be paid to the town of Bandol and allows it to fund costs related to tourism in the city, particularly the protection of natural spaces to ensure the sustainability of this activity. It is paid by the vacationer to the owner at the time of booking via one platform or another. The owner must, while respecting collection and payment periods, declare the number of nights booked to determine the amount to be paid after declaration.

‍

To complete your declaration on the remote declaration platform, you must first create an account using the credentials you received by email from the town after registering your furnished tourist accommodation. You must then declare the number of nights collected before the 15th of each month. Following this declaration, you will receive a summary statement that will allow you to pay the tax by bank transfer, online payment, or check. Once the payment is recorded, you will receive your payment receipt.

‍

The tax collection period runs from January 1st to December 31st. The payment of the tax in Bandol is quarterly and must be made before:

  • April 30th, for taxes collected from January 1st to March 31st; July 31st, for taxes collected from April 1st to June 30th; October 31st, for taxes collected from July 1st to September 30th; January 31st, for taxes collected from October 1st to December 31st.

‍

The tax is 5% of the cost of the night, plus an additional 10% departmental tax.

‍

Note: Even if you have not had any bookings during a period, you must still complete your online declaration. In general, you must collect, declare, and pay your tax for the entire duration your property is available for rent, whether you have tenants or not.

‍

‍

As you can see, the new requirement for Airbnb rentals in Bandol is obtaining a change of use authorization when registering your secondary residence as a furnished tourist accommodation. Short-term rentals are becoming increasingly complex throughout France, but are you familiar with medium-term rentals? This type of monthly rental combines the advantages of short-term rentals (notably attractive rental income) and those of long-term rentals (fewer regulations surrounding secondary residences).
