Following the Airbnb decree implemented in Paris, Nice, and Bordeaux, it is now Lyon's turn to be affected by a change in the law for short-term rentals! In this article, your Airbnb concierge service will explain in detail the law that has applied in Lyon's city center since February 1, 2018.

‍

What does the law regarding Airbnb rentals in Lyon entail?

All owners who engage in short-term rentals must register their property as a "furnished tourist accommodation." This term refers to the repeated use of a property for short-term rental purposes.

‍

Subsequently, your property will be assigned a registration number. This number must be included on your property's online listing; this rule applies to all platforms: Airbnb, Booking, HomeAway, and Club Welkeys. Your Airbnb concierge service reminds you that if you rent out a property for the short term in a French city with more than 200,000 inhabitants, you are required to register your primary residence, and you cannot rent out your property for more than 120 days per year.

How can you continue to offer short-term rentals in Lyon's city center?

Under this new decree, it is prohibited to rent out a primary residence for more than 120 days per year, unlike a secondary residence. However, there are a few rules to follow when renting out a secondary residence:

If your property is smaller than 60m² (approx. 645 sq. ft.), you simply need to request a marketing authorization valid for 9 years. Is the surface area larger than 60m²? The law allows you to rent it out through a compensation system: you must rent out another property in the same district of an identical size (within 5m²) on a long-term basis.

What are the risks if you do not comply with the law?

A fine of €50,000! Your Airbnb concierge service reminds you that only properties located in Lyon's city center are affected!

‍

To qualify for this change, no more than 50% of the units in the building can be registered as furnished tourist accommodations. Additionally, there is a compensation fee to be paid for all changes of use for a property of 100m² in Lyon's city center. However, this procedure is quite lengthy and can be expensive, and your city hall is not obligated to approve the change. Don't worry, your Airbnb concierge service has a solution! Your short-term rental agency has adapted to the new legislation and now holds a real estate management license (Carte G), which allows us to alternate between short-term and medium-term rentals. To help you understand these changes, Lyon en France has created a very comprehensive explanatory diagram:
